The trouble began in Rakra Dhaha village on June 7 when a 22-year-old Rakesh Kumar, a Dalit labourer from Rakradhana village in District Nawanshahr Punjab in India who was picked up by the police on charges of theft a day earlier, was found dead in custody. Though the policemen tried to make it look like suicide no one bought their story.

The angry villagers, who believed in Rakesh’s innocence, then gheraoed the Balachaur police station and sought action against the Tahana SHO.The police acceded to this demand and suspended two Home Gurdas and one Head Constable of the Thana. “But that was just an eyewash”, says Rakesh’s brother, Karam Chand, who found that the police had registered a benami (without any name mentioned) FIR and had not taken any action against the errant cops.

What Law Says about it 

Indian Panel Code (1860)

Sec 302 Punishment for murder- 

Whoever commits murder shall be punished with death, or [imprisonment for life], and shall also be liable to fine.

34 IPC

When a criminal act is done by several, persons in furtherance of common intention of all each of such person is liable for that act in the same manner as if it were done by him alone.

Schedule caste & Schedule Tribe (Prevention of Artocities) Act 1989

Sec 2 (v)

Commits any offence under the Indian Panel  Code(45 of 1860) punishable with imprisonment for a term of ten years or more against a person or  property on the ground that such person is a  member of a Scheduled Caste or a Scheduled Tribe or such property belongs to such member ,shall be punishable with imprisonment for life & with fine.

Migrant Labourer Harrased for ‘Begar’

 A migrant labourer reportedly being harassed for more than two months & compelled him to do begar (act of forced Labour) by a landlord of Village Bir- Baloki in District Kapurthala, Punjab, India . The labourer Ashok (10) who is originally from Bihar told the Police that about two month ago Resham Singh s/o Makhhan Singh allured him & took him to Dera Mehar Singh village Bir- Baloki, where Resham Singh  allegedly compelled him to do forced labour by grazing the cattle.  He also revealed the fact that during the night Resham Singh tied him with the chain & provide him only the wasted food to eat. Whenever he expressed his wish to leave the job, Resham Singh abused him & beat him. Though the victim boy has given his statement in front of the police but no FIR has been lodged so far against the accused.

Law Says about it :

Indian Panel Code (1860)

363A. (1) –Whoever Kidnap any minor or, not being the lawful guardian of a minor, obtains the custody of the minor, in order that such minor may be employed or used for the purposes of begging shall be punishable with imprisonment of either description for a term which may extend to ten years, and also be liable to fine.

(2) Whoever maims any minor in order that such minor may be employed or used for the purpose of begging shall be punishable with imprisonment for life, and shall also liable to fine.

374. Whoever unlawfully compels any person to labour sonment of either description  for a term which may extend to one year, or with fine, or with both.

Bonded Labour System (Abolition) Act 1976

Chapter VI

Punishment for enforcement of bonded labourer –

Whoever, after the commencement of this Act, compels any persons to render any bonded labour shall be punishable with imprisonment for a term which may extend to three years and also with fine which may extend to two thousand rupees.

Punishment for advancement of bonded debt –

Whoever advances, after the commencement of this Act, any bonded debt shall be punishable with imprisonment for a term which may extend to three years and also with fine which may extend to two thousand rupees.

Punishment for extracting bonded labour under the bonded labour system :- Whoever enforces, after the commencement of this Act, any custom, tradition, contract, agreement or other instrument, by virtue of which any person or any member of the family of such person or any dependent of such person is required to render any service under the bonded labour system shall be made to the bonded labourer at the rate of rupees five for each day for which the bonded labour was extracted from him.

Assault on Dalit woman : Cops accused of inaction

 

 

A Dalit woman of Virk Kalan village was beaten up badly by some villagers and then had to allegedly face harassment at the hands of the police and the Administration .Brinder Kaur (35) w/o Bikkar Singh approached to Dalit Dasta Virodhi Andolan about her condition & the same institution admitted her in local Civil Hospital, for treatment of injures inflicted on her body with blunt weapons by the accused, that the accused were angry with her as she had complained to police against them or giving intoxicants to his son. The accused mocked her after police failed to take action against them, she said .Binder said that the alleged culprits assaulted her, on June11 night while she was returning home along with her husband and son. Other villagers rescued her and admitted her at Civil Hospital in Goniana Mandi, from where she was shifted to Bathinda for treatment.

Though she was seriously injured with sharp edged weapons and though she was seriously injured with sharp- edged weapons and lathis, which almost killed her, the police have so far only registered a case under Sections 323/307/151 IPC, pertaining to a simple quarrel.

The woman has sought strict action against the accused

 Dalit Dastan  Virodhi Action Committee leader Sukhwinder Kaur has demanded strict action against the accused villagers and health officials who had ‘failed’ to provide proper treatment to Dalit Woman at Goniana Mandi Civil Hospital.

Landlords boycotts Dalits

 

Tension prevails in Ahmedpur village of District Mansa between Dalits & the landlords of the village over the continuing use of Bondage Labour System. 

Around 20 Dalit Bonded Labourers have shown their interest to break the chain of servitude. In search of Justice they approached to Dalit Dasta Virodhi Andolan (DDVA) Bathinda office and urged to release them. The N.G.O forwards a written application to the district Magistrate Mansa with thumb impression of the bonded labourer. But on the other hand when the landlord of the village came to know that the Dalits Labourer had taken such step against them. They become furious and announced the social boycott of the Dalit in the village they have also announced to impose a fine of Rs. 500 who will help them. They have banned the entry of Dalits in their fields and not allowed them to perform their natural call anywhere in the village land & now nobody allowed them to work and it creates panic among them.

A delegation of DDVA along with the Dalit villagers met the district Magistrate to inform him about the present situation and submitted him a memorandum. Though District Magistrate has given assurance to the delegation that he will take necessary action against the landlord and the position will be normal very soon in the village but still no action has been taken in this regard.

DDVA’s Comments-:

Such case of Social Boycotts is a direct attack on the Fundamental Rights of the poor labourers. Free to work any where is one among the rights which is stated in the constitution. So, no body can stop them to go against their wish.  As bonded labour system is banned in India then it’s the duty of the state to take necessary action if any case comes in theirs states instead of feel afraid of & escape from the problem.

District Magistrate formed Bonded Labour welfare Committee

 

Bonded Labour of village Ahmedpur district Mansa who are facing the social boycott in the villages since last 10 days by the landlords have taken a sigh of relief & a bit blink of positive light from the administration level today, when the district Magistrate announced to formed a Bonded Labour welfare Committee to solve the problems of release, rescue and rehabilitation of Bonded Labours.

In the meeting, decision to aware the bonded labourer about their rights is also considered by Deputy Commissioner Raj Chondery. In the Committee he has give direction to Additional Deputy Magistrate, Sub Divisional Magistrate Mansa, Budladha & Grivences Officer and others along with representative of the different labourer Unions repersentatives.On the occasion Labour inspector Mansa were also present who assured the delegates that he will settle down the long time pending demands of brick Kiln labourers of their salaries.

DDVA Condemned District Magistrate’s statement

National Coordinator of Dalit Dasta Virodhi Andolan (DDVA) Mr. Jai Singh has condemned the District Magistrate Mansa’s statement in which he has claimed that there is no case of Bonded Labour in his district. Mr. Singh has openly challenged District Magistrate to debate on this topic anywhere at any level. He said there are more than 300 case of bonded labour in the district which are forwarded to Punjab Human Rights Commission Chandigarh & Deputy Commissioner of the district Mansa & the copy of the affidavits of the bonded labourer is still in his office. Mr. Singh said that the fact is that the District Magistrate do not want to take this issue because every year they submitted affidavits to the (P.H.R.C) Punjab Human Right Commission which gives clear impression that his district has no case of Bonded Labour. Mr. Jai Singh said that such statement from such a higher level official in a district is a direct attack on the rights of the Bonded Labourer, who are fighting against their right in democracy.

Mr. Jai singh also condemned the attack on the Kailash Satyarathi while he was struggling to release the identified 14 child labour from District Gonda Uttar Pradesh. He also condemned the police for the way of performing their duties. He urged from the Uttar Pradesh (U.P) Govt to investigate the matter & keep vigil on child Labour prevails in the area. He demands a high level enquiry to dig up the facts and urged to prosecute the circus owner for forcing child labour & sexually harassment to the minor girl.
