Tension Prevails in Abadi Chandigarh village of Dinanagar after a scheduled Caste girl was allegedly, abducted and injured by upper caste men. The girl is undergoing treatment for burns at the local Civil Hospital. Her father has accused the Dinanagar police and hospital staff of siding with the village Rajputs.

Girl’s father Mohinder Pal, Who has a tea stall in Behrampur, said on June 11, lovely and her sister had gone to the fields to answer a call of nature, when Munish Singh, a Rajput boy, teased her, the girl’s mother went to the boy’s house and complained about his incident conduct .Later words were exchanged between Pal and Munish, Who was accompanied by two friends. Upset over the events, a group of Rajputs, armed with sharp edged weapons and sticks, attacked his house late in the night, alleged Pal. A clash between Dalits and Rajputs ensued. There was no power and taking advantage of the confusion, the group abducted the girl and left, alleged Pal. They also blocked all the roads leading to Behrampur and Dinanagar to prevent them from approaching the police, he alleged.

Meanwhile, Mohinder and his brothers started looking for the girl found her lying badly injured on the Behrampur-Marara road in Amma village early next day. She was taken to the Behrampur primary health center.

Accusing the Dinanagar police and Gurdaspur Civil Hospital staff of bias, Pal alleged that the FIR was registered on the basis of a weak medico-legal report. Denying the charge, the Dinanagar police and hospital staff claimed they had acted promptly.

Indian Panel Code (1860)

Sec 34 - When a criminal act is done by several, persons in furtherance of common intention of all each of such person is liable for that act in the same manner as if it were done by him alone.

Sec 307- Whoever does any act with such intention or knowledge and under such circumstances that, if he by that act caused death, he would be guilty of murder, shall be punishable with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine, and if hurt is caused to any person by such act, the offender shall be liable either to imprisonment for life, or to such punishment for life, or to such punishment as is hereinbefore mentioned. When any person offending under this section is under sentence of imprisonment for life, he may, if hurt is caused, be punished with death.

 

Sec 354 :- Whoever assault or uses criminal force to any woman, intending to outrage or knowing it to be likely that he will thereby outrage her modesty shall be punished with imprisonment of lither description for a term which may extend to two year.

Schedule caste & Schedule Tribe (Prevention of Artocities) Act 1989

Sec 3(Xi)

Assault or uses force to any woman belonging to scheduled caste or scheduled tribes with intent to dishonour or outrage her modesty.

Shall be punishable with imprisonment for a term which shall not be less than Six months, but which may be extended to five years and with fine.

Dalel Singh wala (Mansa), June 24

It’s been a yea of discontent for Jagga, 25, poor Seeri (agricultural labourer) of Dalel Singh Wala village. Last year in July, he lost his job when the land-owing Jats of the village decided to boycott the Dalits. Today his life has been reduced to one long futile search for work.

Not very far away, Ajab Singh of Ahmedpur village is also facing the blight of joblessness. ‘My day is all about hunting for work, sometimes as far away as 30 Kms.’ He sights, telling you how getting a dihadi is a pain.

Their woes date back to a muggy day in July when Manjit Kaur, a Dalit of Dalel Singh Wala, accused a 70- year- old Jat farmer, Chhotta Singh of trying to outrage her modesty following a standoff between the two communities over the refusal of the Dalits to repay debts of the Jats.Sarpanch Joginder Singh claims It was this incident that snowballed into a boycott announced over the public address system of the gurdwara. 

‘Jats lost 35 lakh in the bargain as all the seeries refused to pay their loans to landlords, ‘says Nambardar Amandeep Singh.

It’s this sum and a social organisation called Dalit Dasta Virodhi Andolan which is coming in the way of any reconciliation between the two sides.

Sitting on a Charpoy in the Dalit part of the village, Jagseer Singh, a representative of the Andolan is high on anti-Jat rhetoric. Exulting at the complete breakdown of communication and interpersonal relations between the Dalits and the Jats, he calls it freedom from servitude, ‘The Jats were charging unreasonable high rates of interest to keep the Dalits in their stranglehold. Now with our support, they have managed to free themselves. Now they can work anywhere, but for the village.

Jats too see some good in the boycott. As Mahender Singh, block samiti member of the Dalel Singh Wala, puts it: ‘Our youth were squandering their money on drugs, and used to idle around the whole day. Now they are forced to tend to their land and that’s a healthy trend.’ But behind closed doors, both the communications agree that the hostilities do not agur  well for them.

The increasing interference by the Andolan activists, who do not let Dalits return to work, is also making many uncomfortable.

What most of worrisome is the special with which this virus of boycott is spreading to other villagers like Ahmedpur  and Kahnpur in Mansa, besides  Kaleanwali and Majhi in Sangrur. Dalits Claim a public announcement o the boycott was made in Ahmedpur village recently even thought sarpanch Gurdeep Singh denies it.

The boycott is not of the whole community but only a few Dalits troublemakers, “He clarifies”  Mansa Deputy Commissioner Raj Kamal Chaudhary admits he has a problem at hand. “Althoght the Andolan officials have tried to link these cases to bonded labour, I am yet to confirm a single cases as per law.

 

A Dalit  beaten to death by Landlords

 

A Dalit Labourer Balkar Singh S/o Sukhdev Singh resident of village Uppal was reportty beaten to death by five landlords of the same village for complaint against them to their family.

Police source said that the incident took place on July 2 evening when Balkar Singh was returning to his home after performing his duty in the fields. On the way the accrued group of landlords who has drunk tried to hit him by the Tractor he escaped from there. But the father of Balkar Singh Sukhdev Singh went to the landlord’s home to complaint against them. This act of the Dalit did not by the landlords instead of say anything to their sons they attacked on Sukhdev Singh and abused him and later capture the Labourer and beaten him to death. Police has registered a case of murder under IPC Act 302 & 34 & started investigation against the assionded accrued tolerated but fortunately.

Objectionable word inscribed on jail inmate’s back

 

In a brutal incident, an objectionable word was allegedly inscribed on the back of a Dalit inmate by the jail doctor and the Deputy Superintendent of jail with the help of some surgical instrument in the jail premises. This has put a question mark on the functioning of the Jails in Punjab where inmates are being treated in inhuman way.

The incident came in to light when the counsel of the jail inmate, identified as Malkiat, moved an application in the court of sessions Judge, Mr. S. K Garg, that his client was allegedly tortured and beaten up by the jail staff and added that the Deputy Superintendent of jail Mr Satpal Singh, along with the jail doctor, Mr Chander Shekher had inscribed an objectionable word on the back of Malkit Singh with the help of some surgical instrument.

Later, Makiat Singh was produced in the court where he narrated his tale of woes. The court ordered medical examination of the inmate before sending him back to the jail and issued notice to the District Attorney to submit a reply by July 12 in this regard.

Talking to reportable outside the court, Malkiat Singh, who was facing allegations of attempt to murder, said his fault was only that he had complained of pain in abdomen to the jail doctor late last. ‘I asked the jail staff and the doctor and the Deputy Superintendent of jail beat me up mercilessly for disturbing them in the night. They later forcibly inscribed objectionable word on my back to teach me a lesson, he added.

The duo said that there are no medicines for Scheduled Castes people. Besides, they threatened me of dire consequences if the matter was reported Singh said who was visibly shaken due to this inhuman treatment.

Dr. Gurpal Singh medical officer on duty in emergency ward of the local Civil Hospital revealed that Malkiat Singh was thoroughly examined and it was confirmed that the objections word was inscribed on his back 24 to 48 hours ago. The wounds on his head and lashes marks on his body were also reported in the medical report, he added.

Tribe Act 1989

Sec 3 (ii) Forcibly removes clothes from the person of a member of a scheduled Caste or a Scheduled Tribe or parades him naked or with painted face or body or commits any similar act which is derogatory to human dignity.

(ix) Gives any false or frivolous information to any public servant and, thereby  causes such public servant to use his lawful power to the injury  or annoyance of a member of a scheduled Caste or a Scheduled Tribe;

(x)  Internationally insults or intimidates with intent to humiliate  a member of a Scheduled Caste or a Scheduled Tribe in any place within public;

DDVA Rescued Bonded Labourer’s Children 

Four minor held hostages by a landlord were rescued on Thusday morning after a warrant office Mander Pal Kohli appointed by Punjab and Haryana High Court raided his premises in Bhagwanpura village of Muktsar District. The childern, including three girls, returned to their father who used to work as a bonded labourer (Siri) with the landlord.

Gurbachan Singh, the landlord, is also a Panchayat member of the village. He had detained Kulbir kaur (14), Surjit (8), Harpreet (7) and Manpreet (3) at his house for more than a month because their father Balkar Singh had complained to the Muktsar Deputy Commissioner about his being held in bondage and had sought help to be freed.

The complaint to the DC was made through a Phillaur-based NGO, Dalit Dasta Virodhi Andolan, which later filed a habeas corpus petition in the high court. Balkar problems increased after he took refuge at the NGO’s office in Phillaur.

Angry at Balkar’s defiance, the landlord took his children, who were staying with their uncle, into illegal custody. He made them do menial jobs. “We were not allowed to go to school. We were beaten up even if one of us dared to move out of us dared to move out of the house,” said Surjit Kaur, a second standard student. “Only one of us was provided one meal in a day on the basis of the work we did for the landlord. The others had to cook for themselves,” added Kulbir Kaur.

Balkar Singh had started working for the landlord about one-and-a-half years ago. He was promised Rs. 18000/- per annum and he took an advance of Rs.8,000/- repayable with five per cent interest. When his wife, who also worked at the household, died, his eldest daughter Kulbir took her place. “I was never paid my full salary. Instead a fine of Rs.100/- was imposed in case I took leave due to illness. I was not allowed to work anywhere else,” said Balkar Singh.

Law Says about it :

Indian Panel Code (1860)

Sec 363A. (1) – Whoever Kidnap any minor or, not being the lawful guardian of a minor, obtains the custody of the minor, in order that such minor may be employed or used for the purposes of begging shall be punishable with imprisonment of either description for a term which may extend to ten years, and also be liable to fine.

(2) Whoever maims any minor in order that such minor may be employed or used for the purpose of begging shall be punishable with imprisonment for life, and shall also liable to fine.

Sec 374. Whoever unlawfully compels any person to labour against the will of that person shall be punished with two years imprisonment.

Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act 1989

Chapter- II

3(1) Whoever, not being a member of a Scheduled Caste or a Scheduled Tribes-

3(vi) Compels or entices a member of a Scheduled Caste  or Scheduled  Tribe to do ‘Begar’ or other similar forms of forced or bonded labour other than any compulsory service for public purpose imposed by Government; Shall be punishable with imprisonment for a term which shall not be less than six months but which may extend to five years and with fine.

Bonded Labour System (Abolition) Act 1976

Chapter VI

Punishment for enforcement of bonded labourer –

Whoever, after the commencement of this Act, compels any persons to render any bonded labour shall be punishable with imprisonment for a term which may extend to three years and also with fine which may extend to two thousand rupees.

Punishment for advancement of bonded debt –

Whoever advances, after the commencement of this Act, any bonded debt shall be punishable with imprisonment for a term which may extend to three years and also with fine which may extend to two thousand rupees.

Punishment for extracting bonded labour under the bonded labour system:- Whoever enforces, after the commencement of this Act, any custom, tradition, contract, agreement or other instrument, by virtue of which any person or any member of the family of such person or any dependent of such person is required to render any service under the bonded labour system shall be made to the bonded labourer at the rate of rupees five for each day for which the bonded labour was extracted from him.
